日本の場合、特許権の設定は、権利者の名義と共に特許庁の記録原簿に登録される。

第二十七条 次に掲げる事項は、特許庁に備える特許原簿に登録する。
一 特許権の設定、存続期間の延長、移転、信託による変更、消滅、回復又は処分の制限
二 専用実施権の設定、保存、移転、変更、消滅又は処分の制限
三 特許権又は専用実施権を目的とする質権の設定、移転、変更、消滅又は処分の制限
四 仮専用実施権の設定、保存、移転、変更、消滅又は処分の制限
米国ではどうかと言うと、特許出願に係る権利や特許権は、発明者からの直接又は間接的な譲渡書(契約書)を証拠として提出する事により、譲受人の名義を登録する事ができる。
譲受人の登録は必須ではないが、万一、二重譲渡が行われた場合、後から権利を譲り受けた第三者に対する対抗要件になる。従って、特に、従業員による職務発明を譲り受けた企業が出願人であるような場合、当該企業にとって、特許権者としての安定した地位を得る為には、実際のところ不可欠な手続きと言える。

Subject to the provisions of this title, patents shall have the attributes of personal property. The Patent and Trademark Office shall maintain a register of interests in patents and applications for patents and shall record any document related thereto upon request, and may require a fee therefor.
Applications for patent, patents, or any interest therein, shall be assignable in law by an instrument in writing. The applicant, patentee, or his assigns or legal representatives may in like manner grant and convey an exclusive right under his application for patent, or patents, to the whole or any specified part of the United States...
An interest that constitutes an assignment, grant or conveyance shall be void as against any subsequent purchaser or mortgagee for a valuable consideration, without notice, unless it is recorded in the Patent and Trademark Office within three months from its date or prior to the date of such subsequent purchase or mortgage.

Assignments of applications, patents, and registrations, and other documents relating to interests in patent applications and patents,..., will be recorded in the Office.
ところで、米国特許商標庁(USPTO)には、出願書面（明細書、図面、IDS等々）の提出先とは別に、特許出願に係る権利や特許権の登録を行う専門部署(Assignment Recordation Branch：ARB)があり、特許出願に係る権利や特許権の登録手続きはUSPTOのARBに対して行う。
因みに、出願に係る権利や特許権のみならず、実施権(license)や担保権(security interest)、更には共同研究契約等についても登録する事ができる。
実際、ARBに譲渡書等を登録をインターネット（Electronic Patent Assignment System: EPAS）を通じて電子的に行う場合、登録対象を選択する手順があって、
選択画面には、譲渡（assignment）、実施権(license)、担保権(security interest)、とか、色々あります。登録対象が選択肢にない場合は、その他(other)を選んで登録対象を自由に特定する事ができます。
